Full Job Title: Principal Regulatory Lawyer – Legal Services

The main responsibilities are to provide professional legal advice and support to the Councils’ development management, strategic planning, planning enforcement and regulatory functions, together with representing the Councils in courts, inquires and tribunals. The Principal Regulatory Lawyer also provides legal advice and support to the Development Management and Licensing Committees.

The Principal Regulatory Lawyer will work with other members of the Legal Services Team to deliver a comprehensive legal service to the Councils. This may involve assisting the Monitoring Officer and the Deputy Monitoring Officers to respond to code of conduct complaints and other governance-related issues.

  • To provide proactive and high-quality support to the Director of Governance and the Head of Legal Services, in relation to the Councils’ development management and strategic planning (including development management process and planning appeals), planning enforcement and regulatory (including licensing, environmental health and housing) functions.
  • To negotiate and draft planning obligations and planning performance agreements
  • To draft notices and other documents related to those functions (including any necessary court documents in connection with the prosecution of offences or defending any appeals).
  • To undertake litigation and to represent the Council and the Head of Legal Services in contested and uncontested proceedings before Courts, Inquiries and Tribunals
  • To provide professional and clear advice (both orally and in writing) to the Councils, Committees, Members and officers on planning, enforcement and regulatory matters.
  • Provide specific advice and support to the Development Management and Licensing Committees
  • To instruct Counsel when authorised and where appropriate and to attend conferences with Counsel
  • To provide training and development to Members and Officers in relation to planning and regulatory matters
  • To assist the Monitoring Officer and Deputy Monitoring Officers to respond to code of conduct complaints and other governance related issues.

 

Specific Role Requirements” – to give yourself the maximum chance of success please try and ensure your CV addresses the following essential criteria:

  1. Practising Solicitor or Barrister (or equivalent qualification and experience)
  2. Experience:
    1. Experience of working in local government sector
    2. Experience working closely with Councillors or partner organisations
    3. Recent experience in planning and regulatory legal matters including drafting, negotiating and finding solutions to complex issues
    4. Experience of working in local government sector and providing advice in Council, Executive, Committee or other public meetings
    5. Recent experience in planning and regulatory legal matters including drafting, negotiating and finding solutions to complex issues
    6. Experience of litigation and advocacy
  3. Skills & Abilities:
  4. Ability to work effectively as part of a team work collaboratively with colleagues at all levels Experience of working across boundaries or different areas of work to achieve desired outcomes
  5. Exercise sound judgement in the public interest, setting out options and risks to Council as necessary Track record for providing legal advice at short notice in a variety of settings
  6. Capable of managing competing priorities and overseeing varied case load.
  7. Ability to give clear explanations whilst advising on complex legal matters
  8. Good verbal and written communication skills including influencing skills
  9. ICT Skills: IT skills including Microsoft packages or equivalent (e.g. G Suite)
