Interim Immigration Lawyer - PSR 1JP00018409

Job Purpose:

To provide expert advice and make decisions on complex, exceptional and high cost applications submitted to the Exceptional & Complex Cases Team, to handle challenges in relation to Director of Legal Aid case work decisions and other associated work by applying the correct statute, regulations, subject specific guidance and case law.

You will deal with applications made for a client by a solicitor but also applications made directly by the client if Exceptional Funding itself.

You will help to build the capability of others by providing feedback, coaching and training for colleagues so they can develop their case work skills and knowledge and will help with the legal supervision o partly qualified paralegals also recruited to deal with Brexit applications.

Knowledge
• Legal qualification as a solicitor, barrister or FILEX with two year’s post qualification experience (PQE) on recruitment in the specialist area of immigration, asylum, nationality, human rights and public law.
• Of statutes governing relevant areas of law, immigration rules, policies and case law.
• Understanding of main concepts of public law, reliable legal judgement and legal and costs risk.

Decision Making and Analytical skills
• Ability to analyse large amounts of information, to independently research relevant case law, country guidance, policy, immigration rules, EEA regulations and statute and to apply discretion and reasoned judgement in instances of ambiguity or where limited guidance is available.
• Ability to apply legal principles to make reliable professional judgement to independently assess prospects of success, benefit and costs.

Communication skills
• Ability to explain in writing and verbally by telephone the rationale behind the decisions that you have made and the criteria that you have applied.
• Ability to adapt your style of communication depending on whether you are speaking to colleagues, providers or clients, ensuring that you use Plain English where necessary.
• Ability to challenge and question solicitors, barristers (including QCs). Ability to spot legal gaps in the presentation of a case and the ability to challenge specialist providers on their estimates of prospects of success, costs and benefit.

Interpersonal Skills
• An ability to deal with and relate to people, including vulnerable clients, quickly establishing rapport and responding swiftly to their enquiries.

Planning & Organisation
• Ability to work without supervision, prioritising your own work, managing competing priorities and making decisions within tight timescales. Ability to adapt quickly to changes including processes and timetables and support others to do the same.

Building your own and others capability
• Able to respond positively to feedback to improve your own performance and seek out and share experiences to improve the quality of the service we offer. Ability to provide fair and accurate feedback to others to help them develop.

IT literacy
• Good understanding of how to use Office Tools including Word and Excel etc.
