Hybrid role

The part time post (2-3 days per week) is for an Adult Safeguarding/Education Lawyer to provide legal advice and services to the client departments and the Council itself and involves significant levels of advocacy in the Court of Protection, the Special Educational Needs Tribunal and other tribunals. This requires attendance at court approximately once a month.

Key responsibilities:

  • Carry out the duties with full regard to the Council’s Corporate Plan, the Corporate Equality and Diversity Policy and Health and Safety Policy.
  • Undertake the provision of legal advice, guidance and support on behalf of the Council (and its schools) in relation to Adult Social Care and Education matters (including Court of Protection applications and questions relating to Education Law).
  • Conduct advocacy at all levels with respect to the above matters before the Court of Protection, the SEND Tribunal and any other appropriate tribunal.
  • Proactively advise and respond to all requests for legal advice. Advising on the proposed impact of any legislation as and when appropriate to the Client Departments.
  • Undertake all preparations in relation to Advocacy including preparation of bundles, skeleton arguments and statements ensuring full compliance with legislation and guidance, attendance at advocates meetings and to liaise with Counsel as and when required.
  • Attend relevant meetings including where applicable Safeguarding Board meetings, Joint Partnership Groups, and Legal Gateway meetings.
  • Carry out the duties with full regard to the Council's Community Plan, Community Safety Strategy, Corporate Equality Plan, Health and Safety Policy and Social Inclusion Strategy.
  • Carry out all duties with due regard to confidentiality and data protection regulations.
  • Responsible for contributing to and compliance with strategies and policies relating to safeguarding and promoting the welfare of children and vulnerable adults.
  • Provide occasional supervision to Solicitors, Senior Legal Assistants, Legal Assistants, Trainee Solicitors, Legal Apprentices and other junior members of staff as and when required.
  • Deputise regularly for the Senior Solicitor (Adult Social Care and Education) and the Legal Services Manager (Safeguarding) and occasionally for the Director of law and Governance as and when required.
  • Assist occasionally any team in Legal and Democratic Services. This can include working outside of normal office hours and working off site.

Qualifications:

  • A Solicitor, either with a current practising certificate or eligible to apply for a practising certificate, or a qualified Barrister or a Fellow of the Institute of Legal Executives, or possessing an equivalent qualification gained in another jurisdiction.

 

Skills & Experience:

  • Excellent communication and team skills.
  • Ability to interpret legislation in a common sense and practical manner, having due regard to the Council’s legal responsibilities.
  • An understanding of the concepts underpinning administrative and corporate law as it relates to local government.
  • Knowledge of the law relating to the area of service where the assignment is based.
  • An awareness of the issues that face local government.
  • Substantial experience within the legal profession.
  • Experience of providing legal advice in the area of the assignment.
  • Excellent oral and written communication skills, and the ability to present to diverse audiences, including elected Members, senior officers, staff and external agencies.
  • Ability to analyse, use and present complex data in a clear and informative way.
  • Strong IT skills using Microsoft packages or equivalent (e.g. G Suite).
