Temporary Licensing Enforcement Officer – Community Services

Requirement to work outside normal office hours
A Licensing Enforcement Officer is required to cover the range of licensing functions including Licensing Act, Gambling Act and caravans. Experience in taxis would be of special benefit. Attendance at the office is required 2 days per week to carry out enforcement duties and liaise with the team. A degree of administration work is also required e.g. entering actions onto the idox Uniform database and drafting letters and notices. Jointly responsible for the delivery of the inspection programme and enforcement across the district. Candidates should preferably live within 30 miles of Harrogate in order to respond swiftly if needed.
Key responsibilities:
- Licensed premises/vehicles inspections, investigations and enforcement – including complaints and night time work and specialist lead officer work.
- Take a lead role for the provision of complex specified service areas. Deal with complex and non-routine enquiries.
- Responsible for developing and reviewing policy and procedures e.g., Taxi “Rulebook”, Criminal Record, Enforcement, Licensing Act, Gambling Act, Street Trading, charity collections etc.
- Interview drivers for licences to drive Hackney Carriages and Private Hire vehicles. Decide on the fitness and suitability of applicant’s, vehicles, premises and records to comply with the standards required under legislation before the issue of licences. Meet and deal with licence holders on problems they may have regarding the regulations etc.
- Deliver a risk based inspection programme of all licenced premises focussed on performance targets e.g. animal boarding, riding establishments, zoos, scrap metal, licenced premises, alcohol, gambling, caravan sites etc.
- Decide when a licence application has been properly submitted, and where relevant, decide what conditions should be attached to a licence. Decide on licence approval or refusal making reference to local procedures, council policy, legislation, government guidance and regulations to a greater or lesser degree depending on availability. Refer to a hearing when appropriate.
- Determine contested applications, reports to hearing and court at appeal.
- Investigate complaints concerning licensed premises, vehicles and unlicensed activities and work with partner agencies such as police and trading standards to ensure compliance with legislation.
- Take enforcement action, serve legal notices, suspend and revoke licences as appropriate. Responsibility for enforcement outside of normal working hours. Undertake recorded interviews under caution. Prepare prosecution file in accordance with the Safer Communities Enforcement Policy. Prepare own witness statements and those of witnesses, attend court and give evidence.
- Arrange vehicle Compliance Tests in accordance with the Hackney Carriage regulations and issue certificates. Liaise with garages re problem vehicles, visit garage if required and adjudicate where vehicles have failed. Handle any complaints from the garage against the driver of the Hackney/Private hire vehicle when attending their Compliance Test.
- Required to work outside normal office hours.

- Strong IT skills using Microsoft packages or equivalent (e.g. G Suite).
- Should preferably live within 30 miles of Harrogate in order to respond swiftly if needed.
